The website www.winelevenen.it (herinafter “Site”) is owned and managed by Wineleven S.r.l. (for the company data see point 8), as the Data Controller of the information collected by the users (hereinafter referred to as “user”, “users” or “you”).
The Data Controller with appropriate evaluations in accordance with art.37 has excluded the need to proceed with the appointment of a Manager of the Data Protection (DPO).

The security measures applicable to this Site have been defined and developed to ensure that
that the information provided by users is treated in compliance with the principles of lawfulness, correctness, transparency, purpose and storage limitation, data minimisation, accuracy, integrity and confidentiality, in accordance with current national and European regulations.

This information (or privacy policy) is provided in accordance with article 13 of Legislative Decree 196/2003 (hereinafter “Privacy Code”) and article 13 of the EU General Regulation on Data Protection (hereinafter “RGDP”) and explains how to use, share, access, modify or delete personal information provided and processed by you. The information is also based on Recommendation no. 2/2001 on minimum requirements for online data collection in the European Union, adopted on 17 May 2001 by the Working Party, Article 29.

This privacy policy is provided only for this Site and does not apply to any other websites possibly consulted by the user through links on the pages of the Site.

1. Personal data subject to processing

“Personal Data” means any information concerning an identified or identifiable with particular reference to an identifier such as the name, a number of identification, location data or an online identifier.
The Personal Data collected by the Site are as follows:

Navigation data

The computer systems and software procedures for the correct functioning of the Site acquire, in the course of their normal exercise, some Personal Data whose transmission is implicit in website navigation.

This information is not collected to be associated with identified individuals; however, for their very nature could, through processing and association with data held by third parties, allow users to be identified.

These include IP addresses or the names of the computers used by users who connect to the Site, URI (Uniform Resource Identifier) addresses of requested resources, time of request, the method used when submitting the request to the server, the size of the file obtained in response, the numeric code indicating the status of the response given by the server and other parameters related to the operating system and the IT platform used by the user.

The above data are used for the sole purpose of obtaining anonymous statistical information on the use of the Site and to check its correct functioning.
The data may be used for 
the ascertainment of liability in the event of hypothetical computer crimes against the Site.

Data provided voluntarily by the user

Through the Site, the user has the possibility to voluntarily provide Personal Data, such as the name and the e-mail address to contact Wineleven or leave a comment through the forms on the Site.

Wineleven may also request you to provide certain information in the event that you check for problems with services on the Site.

The personal data provided in this way are used for the sole purpose of satisfying or responding to requests transmitted and are communicated to third parties only if this is necessary for this purpose.
In this sense, the user shall grant the widest possible indemnity in respect of any dispute, claim, claim for compensation for damage caused by treatment, and so on that it should reach Wineleven by third parties whose Personal Data has been processed through your use of the Site in violation of applicable law.

2. Purpose and legal basis of data processing

The Personal Data you provide through the Site will be processed by the Owner for the following purposes:

    1. purposes related to the provision of services available through the Site (e.g.: contact request
      through the forms on the Site);
    2. purposes of statistical research/analysis on aggregated or anonymous data, without therefore the possibility of identify the user, aimed at measuring the functioning of the Site and the related operational functions, including the resolution of any technical problems;
    3. purposes aimed at preventing or preventing fraudulent activity or misuse that may damage the Wineleven site, or compromise the safety of operations;
    4. purposes relating to the fulfilment of a legal obligation to which Wineleven is subject;
    5. purposes necessary to ascertain, exercise or defend a right in a court of law or whenever necessary the courts shall exercise their judicial functions.

The legal basis for the processing of Personal Data for the purpose referred to in point a) above is the provision of a service or response to a request, which does not require the user’s consent, under the terms of the service or response to a request, which does not require the user’s consent applicable legislation.

The purpose referred to in point b) does not involve the processing of Personal Data, while for what concerns points c) and e), the processing is necessary for the pursuit of a legitimate interest of Wineleven.

Finally, the purpose referred to in point d) represents a legitimate processing of Personal Data because necessary to fulfil a legal obligation to which Wineleven is subject.

3. Provision of information and consequences of any refusal

The provision of your Personal Data is optional: you are free to provide your personal data reported in the forms present on the Site or in any case indicated in the contacts with the Owner; this may be prevent users from using the Site and the services listed in point 2.b of this notice privacy.

Through the Site, we never ask you for data of a sensitive nature (data relating to the origin of the information you provide to us racial and ethnic, religious, philosophical and political beliefs, etc.) or judicial (data on the matter of criminal record, or relating to the status of defendant or suspect).

4. Methods, logic of treatment and storage time

The processing of users’ information is carried out only if strictly necessary, including with the aid of electronic or automated means and is carried out by Wineleven and/or third parties which Wineleven can use to store, manage and transmit the data (for more details see point 5).

The processing will be carried out with logic of organisation and processing of your Data Personal, also related to the logs originating from the access and use of the services made available via web, related to the above mentioned purposes and, in any case, in order to guarantee the safety and the data confidentiality.

The Personal Data processed will be stored for the times foreseen by the Privacy Code, the RGDP and by the legislation in the applicable time and, in any case, for the duration strictly necessary to the achievement of the purposes indicated in point 2. More details about the period of retention of Personal Data and/or the criteria used to determine this period may be requested by writing to the Data Controllers (see point 8 for company details).

5. Security

Wineleven is committed to protecting the security of your Personal Data when sending it.
The information on purchase operations (e.g. credit card number) are managed in such a way that safe, through selected suppliers who guarantee to take the most appropriate security measures.
In any case, Wineleven recommends the adoption of appropriate protection against unauthorised access to your password and your computer.
Always make sure you are logged out when using a computer shared with other users.

6. Recipients and thirs parties to whom your data may be disclosed

Your Personal Data may be shared, for the purposes specified in point 2, with:

  • • employees and consultants authorised to manage the Site and provide related services (customer service, management of IT systems, etc.), as subjects in charge of the processing and/or system administrators and/or internal data processors;
  • • employees and consultants in the finance, administration, accounting and other offices of Wineleven, as data processors and/or internal processors.

Wineleven may also request its service providers to perform certain operations of processing of data on its behalf, in its capacity as external data controller, in accordance with the provisions of the instructions provided by Wineleven itself and in line with this privacy policy.

These include, but are not limited to, the following:

  • • suppliers of services for the management of computer systems and the Site ;
  • • suppliers of on-line payment services for the purchase of products and services indicated on the Site, who can access your credit card information and other financial information;

The user’s information may also be communicated to the following parties or categories of parties subjects:

  • • police forces, armed forces and other public administrations in order to fulfil obligations
    provided for by laws, regulations, protocols and national or European legislation;
  • • agencies or professionals for debt collection (e.g. outstanding debts to us) or for Wineleven’s defence in court, for example in the event of violations by network users.

The parties mentioned will process the information as independent data controllers.

7. Data of under-age users

The Site is not intended for children under 18 years of age and Wineleven does not knowingly collect Personal Data from themselves. In case of accidental registration of any information about minors, Wineleven will delete them in a timely manner at the request of users.

8. Data controllers and data processors

The Data Controller of the users’ data is Wineleven S.r.l., in the person of its own pro tempore legal representative, with registered office in Appiano sulla Strada del Vino (BZ), Strada Riva di Sotto 36.

The updated list of data processors and persons in charge of processing is as follows located at the registered office of the Data Controller. For any further information or clarification, the Owner may be contacted at the address indicated, i.e. at the address e-mail privacy@wineleven.it .

9. User rights

We inform you that art. 7 of the Privacy Code and art. 15 et seq. of the RGDP confer to the users the exercise of specific rights against the Data Controllers. In particular you can:
  • • obtain confirmation of the existence of and access to Personal Data concerning you, even if not still registered, and ask to know their origin, as well as the purposes, the times of storage, the modalities of the treatment and the logic applied in case of treatments carried out with automated tools;
  • • revoke any consent given in relation to the processing of your Personal Data, without prejudice to the lawfulness of the treatment in place up to that moment;
  • • receive the Data in a structured format, in common use and readable by automatic device Personnel treated and, unless it is technically not feasible, to directly transmit the your data to another Data Controller;
  • • obtain the cancellation, transformation into anonymous form or blocking of data of which it is not necessary storage in relation to the purposes for which the data were collected and processed;
  • • obtain the updating, rectification and integration of the processed data;
  • • oppose, in whole or in part, for legitimate reasons, the processing of personal data concerning you, although relevant to the purpose of the collection;
  • • submit a complaint to the Control Authorities.
The exercise of these rights must not prejudice and/or harm the rights and freedoms of others. The user may exercise these rights at any time by writing by post to the address of Appiano sulla Strada del Vino (BZ), Strada Riva di Sotto 36 or by e-mail at the e-mail address privacy@wineleven.it. It is understood that, where requests are submitted by electronic means, the information will be provided free of charge and in a commonly used electronic format. Should the user’s requests be manifestly unfounded or excessive, in particular for the repetitive in nature, Wineleven may alternatively: charge a fee for expenses reasonable taking into account the administrative costs incurred in providing the information or the communication or take the requested action; or refuse to comply with the request. At both circumstances the Owner provides adequate justification to the user.

10. Changes to the Privacy Policy

This privacy policy is in force from 10.09.2020. Wineleven reserves the right to modify or simply update the content, in part or completely, also due to variations of the applicable legislation.

We therefore recommend that you check this section regularly to learn more about the most recent and updated version of the privacy policy so that the user is always updated on the data collected and its use by Wineleven.

In the event that Wineleven makes any changes that are deemed important, users will be informed through the Site.
